In addition, WINDOWSIGHT may provide its services through other applications, software, or platforms, including white-label or co-branded versions distributed under different names, which remain owned and operated by WINDOWSIGHT S.L. (hereafter, “WINDOWSIGHT” or “WindowSight”).

The User may send WINDOWSIGHT their complaints, claims, or any other comment that they wish to make through the contact information provided at the beginning of these Terms & Conditions.
These Terms & Conditions are made available in English. Translations may be provided for convenience; however, the English version shall prevail.
The present Terms and Conditions described below define the rights and obligations within the framework of our app and website and in commercial transactions between WINDOWSIGHT and its Users (including all types of users and artists). For these purposes it is understood that the activity that WINDOWSIGHT develops through its web includes the visualization and provision of audiovisual content.
The collection and processing of personal data by WINDOWSIGHT is governed by our Privacy Policy, available at https://windowsight.com/privacy-policy/. Users may exercise their rights of access, rectification, deletion, or other rights under applicable data protection law as described therein.
At WINDOWSIGHT we do our utmost to ensure that the services offered on our website are described accurately and precisely. However, the visual (images and videos) or written information and data included for each product or service is for informational and guidance purposes only, and therefore WINDOWSIGHT is not liable in any way for any mistakes in said information.
WINDOWSIGHT reserves the right to modify the present terms and conditions. Any new version of the latter will be notified to Users in advance with due notice.
In the event that any of the clauses of the Terms & Conditions are declared illegal or not enforceable by a judicial decision, the other provisions will remain in force.
In the event the Users come from third-party websites, WINDOWSIGHT has no control over the content of such sites and, in any case, is not responsible for the accuracy of such information or the use made of it. WINDOWSIGHT will not exercise any control over such sites and content. Furthermore, it will not be liable for any damage caused by the use of such links or the information contained therein, even when expressly informed of the possibility of damage.
Links to third-party sites do not imply endorsement of their content by WINDOWSIGHT. Such links are provided solely to inform the User of the existence of other sources of information or commercial interest. WINDOWSIGHT may also make its services available through third-party platforms, applications or devices, including white-label or co-branded versions distributed under different names. In all such cases, WINDOWSIGHT remains responsible solely for the provision of its own service and content, and shall not be responsible for the functioning, availability, errors, security, or practices of such third-party platforms, applications or devices.
The User acknowledges and agrees that access to or registration on the Platform may have occurred through a third party, including but not limited to third-party websites, commercial partners, white-label solutions, or integrated environments such as smart TVs or similar devices. In such cases, the User may register for the Platform and, where applicable, complete payment through the relevant partner. Notwithstanding the foregoing, such users shall be deemed users of the Platform, and any use of the Platform constitutes the User’s full and unconditional acceptance of these Terms and Conditions, which shall apply regardless of the channel, device, or intermediary through which the User registered or made payment. Accordingly, the User agrees to comply at all times with the Platform’s Terms and Conditions.
To use the services provided by WINDOWSIGHT, you must register and become a User. Registered Users (including those with the membership type as Artists) declare and accept, at all times, to:
In the event that an artist or the platform decides to remove any of its contents, it will no longer be available to the user.
WINDOWSIGHT reserves the right to suspend, restrict, or terminate any account, with or without prior notice, at its sole discretion. This includes, but is not limited to, cases where WINDOWSIGHT reasonably believes that the User has violated these Terms, applicable law, failed to validate their email or complete the registration process, or remained inactive for an extended period. Accounts may also be removed in error due to technical or administrative reasons, and WINDOWSIGHT shall not be held liable for any loss, damage, or inconvenience resulting from such removal. Users may contact WINDOWSIGHT at support@windowsight.com to request clarification or recovery where possible. WINDOWSIGHT may, where feasible, attempt to recover such accounts if the User contacts support.
To register in WINDOWSIGHT, you must access the “Sign Up” section.
*Please note that Free Trials are not guaranteed, may not be available in all regions, and may be discontinued or modified at any time. WINDOWSIGHT reserves the right to establish or remove Free Trials at its own discretion.
Within your account section “Settings” you can always change your type of account or membership. All changes will be managed by STRIPE.
To be a WINDOWSIGHT User with a BUSINESS Account you have to contact WINDOWSIGHT through email business@windowsight.com or through the page: https://windowsight.com/business-contact/
The conditions of your Business account, pricing, payments, number of devices, etc. will be agreed with WINDOWSIGHT via email. Once they are agreed, WINDOWSIGHT will turn your account into a Business account.
WINDOWSIGHT can delete your Business account or convert it into a member account in the case you don’t keep with the agreed payments.
In addition, Users who access the WINDOWSIGHT platform through authorized third-party integrations (including but not limited to white-label or partner applications) and who are granted rights for public or commercial display of artworks shall be considered Business Accounts for the purposes of these Terms, even if their account is created or managed through such third-party solutions.
The right to publicly display artworks through the WINDOWSIGHT platform, whether accessed directly or via third-party integrations, is strictly limited to accounts authorized for Business use. Such accounts may use the WINDOWSIGHT platform in public or commercial spaces solely for editorial display purposes through the platform. No rights are granted to reproduce, market, advertise, print, or otherwise commercially exploit the artworks outside of such platform display.
Business Accounts are also subject to all other obligations set out in these Terms, unless expressly stated otherwise.
The service is accessible through different platforms, including the website, mobile applications (smartphones) and Smart TV applications. Depending on the platform used, cookies or similar technologies may be used to analyse user’s activity through the platform, including technologies provided by third parties such as Google Analytics/Firebase.
The use of these technologies shall be subject to the user’s consent, where legally required, and shall be governed in accordance with European data protection and information society services regulations. Detailed information on the cookies or similar technologies used, as well as the options to accept, reject or configure their use, is available in the relevant Cookie Policies applicable to each platform.
To be a WINDOWSIGHT artist you must follow the following process.
The duly registered Users can carry out transactions on the website by the established means and forms. They must follow the online purchase procedure of windowsight.com, through the “settings” page in the “account” section.
The process to follow will be as follows:
The price of the account type offered on the windowsight.com website is indicated in the currency by default. Prices will be always indicated with all taxes included.
The percentage shared with artists is applied to the membership fee after subtracting direct charges, taxes and commissions.
WINDOWSIGHT reserves the right to modify prices at any time including promotions and discounts.
The works will remain the property of the artists themselves who are part of the WINDOWSIGHT platform even after the payment made by the User who is only purchasing the access of the content for a limited period of time through and only through the WINDOWSIGHT platform.
The User acknowledges being aware, at the time of purchase, of certain particular conditions of sale that concern the product in question and that are shown next to the presentation indicating, by way of example, but not exhaustive, and attending to each case: name, description of the work, characteristics and recognizes that the realization of the purchase of content display rights materializes the full and complete acceptance of the conditions.
The User acknowledges that the content that User has access to on the platform through a paid or free plan can be modified at any time, including being removed from the platform and that this would not entitle the User to ask for any refunds.
In the case the User changes from “Supporter” to “Supporter Plus” account, their new account will start that same day. WINDOWSIGHT will recalculate the new billing date depending on the non used credit by the User from the last payment.
In the case the USER changes from a higher cost account to a lower cost account, the USER will retain the privileges of the higher cost account until the end of the paid month. The USER must inform WINDOWSIGHT about this change before the renewal date.
Unsubscribe Process for private Users (Member, Supporter, Supporter Plus): You can unsubscribe or delete your account at any time through the “Settings” page in the “Account” section at https://web.windowsight.com/settings/account.
Unsubscribe Process (Artist Account): To delete your account as an Artist with your Agreement already signed, you have to contact WINDOWSIGHT through the email artist@windowsight.com. WINDOWSIGHT will proceed to deactivate or delete your account depending on the conditions agreed within both parties.
Unsubscribe Process (Business Account): To unsubscribe from your Business account, you have to contact WINDOWSIGHT through the email business@windowsight.com. WINDOWSIGHT will proceed to deactivate or delete your account depending on the conditions agreed within both parties.
Payment is managed by STRIPE and its accepted payment methods, including credit and debit cards, Apple Pay, Google Pay and Link.
When entering the payment information and completing a payment, the User acknowledges and agrees that the collection, storage, and processing of banking information (including but not limited to credit or debit card details, bank account information, and any other accepted payment methods) are processed directly by Stripe and can be communicated to and managed by WINDOWSIGHT. You can learn more information about how STRIPE processes personal data by reading its Privacy Policy:
If a User is unduly charged the amount of a purchase, without there being bad faith on its part, the user may request the cancellation of the charge by sending an email to WINDOWSIGHT. Once the request is validated by WINDOWSIGHT and if approved, the corresponding amount will be refunded in the shortest possible time according to the payment method.
In the event in which the user acquires (prior payment) the condition of the Supporter or Supporter Plus but has not displayed of any content or used any feature limited to such Plans, they will have a period of 14 days to exercise the right of withdrawal by contacting WINDOWSIGHT at support@windowsight.com and contrast the information and, if applicable, the amount paid will be returned.
However, in the moment in which the user acquires (prior payment) the condition of the Supporter or Supporter Plus, and displays any content or feature that would be locked unless holding this plan, the User is aware of the loss of the right of withdrawal.
Users will have access, through the WINDOWSIGHT platform, to content uploaded by artists, subject to their account type, region, and any applicable restrictions established by WINDOWSIGHT. Access to specific content or features may vary depending on whether the User has a Free, Supporter, Supporter Plus, Business, or Artist account, and may also depend on licensing or legal limitations in particular countries or regions.
WINDOWSIGHT reserves the right to modify at any time the availability of its content and features, including by making previously free content or features available only to paid Users, by restricting certain content or features to specific account types (e.g., Supporter, Supporter Plus, Business), or by limiting access to certain content in particular countries or regions due to licensing, legal, or technical reasons. Users acknowledge that not all content or features will be available across all account types or in all territories, and that WINDOWSIGHT shall bear no liability for any such limitations.
WINDOWSIGHT also reserves the right, at any time and at its sole discretion, to modify, restrict, or remove any content from the platform, without prior notice and without liability to the User. In addition, if an artist decides to remove any of their content, such content will no longer be available to Users.
Unless expressly stated otherwise, most of the artistic creations that appear on the platform are provided by independent artists, and WINDOWSIGHT is not their creator. WINDOWSIGHT makes reasonable efforts to ensure that all content and related information shown on the platform is accurate, whether provided by artists or managed directly by WINDOWSIGHT. However, occasional errors, omissions, or differences may occur, and WINDOWSIGHT shall not be held liable for such inaccuracies.
Some content may consist of works in the public domain or works curated, digitized, or managed directly by WINDOWSIGHT, or by third parties providing such content to the platform. In all such cases, any curation, transformation, digital version, or presentation created or provided by WINDOWSIGHT remains owned or controlled by WINDOWSIGHT and is made available solely for display through the platform. Public domain status of a work does not grant Users any additional rights beyond those expressly provided in these Terms. All such content remains subject to the same limitations as other content on the platform, and Users receive no rights to reproduce, modify, distribute, or otherwise exploit such content outside the permitted display.
All intellectual property rights in the artworks remain with the artists. Users receive only a limited, non-exclusive, non-transferable right to display the artworks via the WINDOWSIGHT platform, subject to the chosen account type. No license is granted to reproduce, distribute, advertise, market, merchandise, or otherwise commercially exploit the artworks beyond the permitted display.
If you believe that any content available on the platform infringes rights or is unlawful, please notify WINDOWSIGHT at legal@windowsight.com WINDOWSIGHT will review such notices and may remove or restrict content at its discretion.
Some of the artworks and photographs available on the WINDOWSIGHT platform may contain nudity or mature themes. Such content is intended exclusively for artistic, educational, or documentary purposes (for example, fine art or photojournalism) and never includes pornography or adult entertainment.
WINDOWSIGHT applies a paywall so that nudity and mature content may only be accessible through Supporter or Supporter Plus accounts, and is not intended to be available to Free accounts. However, Users acknowledge that due to tagging errors, technical issues, or circumvention, such content may occasionally be accessible outside the intended paywall, and WINDOWSIGHT shall bear no responsibility for such cases.
WINDOWSIGHT takes reasonable efforts to review and tag content that may contain nudity or mature themes, based on our internal guidelines. For the purposes of these Terms:
– “Nudity Content” refers to artistic or documentary representations of the human body without full clothing, regardless of gender or medium (e.g., The Birth of Venus by Botticelli).
– “Mature Content” refers to imagery that may be emotionally sensitive, such as scenes of conflict, blood, or other impactful subjects (e.g., war photojournalism).
WINDOWSIGHT does not guarantee that all such content will be perfectly classified or filtered, as interpretations of what is “explicit” or “sensitive” may vary by individual. Users acknowledge that occasional errors or omissions may occur in the tagging of content, and WINDOWSIGHT shall not be held liable for any perceived misclassification or for any offense taken by the User.
WINDOWSIGHT does not provide parental controls and does not restrict nudity or mature content by age, beyond the paywall requirement described above. Users are solely responsible for managing account settings and access, including whether minors or other household members may view such content. Users accept that minors may be able to access nudity or mature content through their accounts and that WINDOWSIGHT shall not be responsible in such circumstances.
For Business Accounts or other public/commercial displays, Users are solely responsible for the content they choose to display in their premises. WINDOWSIGHT provides tools and filters, but cannot guarantee that playlists, recommendations, or curation provided by WINDOWSIGHT will exclude nudity or mature content. By using the platform in public or commercial spaces, Users accept full responsibility for the choice of content displayed and release WINDOWSIGHT from any liability for any perceived offense, loss, or damage arising from such display.
By registering for and using the WINDOWSIGHT platform, Users accept responsibility for the content they may encounter, including nudity and mature themes, and release WINDOWSIGHT from any liability arising from exposure to such content in private, public, or commercial settings.
WINDOWSIGHT takes the necessary measures to ensure that the content offered complies with all current legislation and in accordance with the information offered by the artists, so it cannot be held liable for any damages or legal violations that may arise in this regard.
WINDOWSIGHT shall not be held liable for any indirect damages or business losses (including lost profits, income, contracts, or reputation) or for any other indirect, incidental, or consequential loss, whether or not foreseeable, arising from the use or inability to use the platform, regardless of whether the User has created an account, is using a free plan, a paid plan, or is merely accessing the platform as a visitor.
Users acknowledge that the platform includes artistic and documentary content, which may contain nudity or mature themes. WINDOWSIGHT takes reasonable steps to classify and tag such content, but cannot guarantee perfect accuracy and cannot be held liable for any offense, distress, personal trauma, or other reaction that Users or third parties may experience when exposed to such content.
To the fullest extent permitted by law, WINDOWSIGHT’s liability shall be limited to cases of bad faith, intentional misconduct, or gross negligence, and in no case shall WINDOWSIGHT’s liability exceed the total amount paid by the User to WINDOWSIGHT, if any, during the twelve (12) months preceding the event giving rise to the claim.
Subject to the provisions of the preceding paragraphs, the responsibility of WINDOWSIGHT under these Terms & Conditions may not exceed an amount equal to the amounts paid or payable after the transaction that is at the origin of said responsibility, whatever be the cause or form of the action in question.
WINDOWSIGHT cannot be held liable for breach of the contract signed in case of inability to access your account by means other than WINDOWSIGHT or force majeure, interruption of the activity or total or partial strike, in particular, the telematic services of the area where the user is.
By using this website, the user accepts that communications with WINDOWSIGHT are electronic (email or notices published on the website or app). For contractual purposes, the user agrees to use this electronic means of communication and recognizes that any contract, notification, information and other communications that WINDOWSIGHT sends electronically meet the legal requirements of being in writing. This condition will not affect the rights recognized by law to the user.
The user can send notifications and communicate with WINDOWSIGHT through the contact details provided in these Terms & Conditions and, where appropriate, through the contact spaces on the website. Likewise, unless otherwise stipulated, WINDOWSIGHT may contact and notify the user by email.

No waiver of WINDOWSIGHT to a specific legal right or action or the lack of requirement by WINDOWSIGHT of the strict compliance by the user of any of its obligations will imply, nor a waiver of other rights or actions derived from a contract or the Terms & Conditions, nor will the user be exonerated the fulfilment of their obligations. No waiver of WINDOWSIGHT to any of these Terms & Conditions or to the rights or actions derived from a contract will take effect, unless it is expressly established that it is a waiver and formalized and communicated to the user in writing.
If any of these Terms & Conditions were declared null and void by a final resolution issued by the competent authority, the rest of the clauses will remain in force, without being affected by said declaration of nullity.
The access, navigation and use of this website and the contracts for the purchase of products through it will be governed by Spanish legislation.
For consumer Users residing in the European Union, disputes shall be resolved in the courts of the User’s place of residence, in accordance with applicable consumer law. For consumer Users residing outside the European Union, disputes shall, to the extent permitted by applicable law, be resolved exclusively in the courts of Barcelona, Spain. If local mandatory consumer protection laws grant jurisdiction to the courts of the User’s country of residence, those laws shall prevail.
For Business Accounts or other non-consumer Users, disputes shall be resolved exclusively in the courts of Barcelona, Spain, and the parties expressly submit to the jurisdiction of such courts. Proceedings shall be conducted in Spanish. The parties may jointly request the use of Catalan or English language.
If a contract between WINDOWSIGHT and the User emanates a dispute, the User as a consumer may also request an out-of-court dispute resolution, in accordance with EU Regulation No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on the resolution of online litigation in matters of consumption.
